ADDENDUM

The purchaser of each lot is deemed to purchase with notice and full knowledge of the important notice to bidders, the Common Auction Conditions, where applicable, the special conditions of sale and this addendum.
The purchaser of each lot is deemed to have inspected the property and have verified the accuracy of all information given in the particulars including the extent of the premises to be sold and the floor areas. Additionally, the purchaser is deemed to have read the legal documentation.
The boundary plans in the auction catalogue are for identification only. The correct title plan showing the boundaries of the properties are available for inspection and the purchaser will be deemed to have purchased with full knowledge thereof.
Please note that vendors may require a supplementary amount to be paid by the purchaser to the vendor over and above the purchase price. Please check the special conditions of sale to ascertain whether this applies to the property for which you are bidding.
The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 came into force on the 26th June 2017.
Under the Regulations, Acuitus is legally required to immediately undertake customer due diligence checks on the buyer and related parties.
Acuitus will need to receive identification documents that satisfy the Regulations for the bidder, the buyer (if different from the bidder), the beneficial owners with more than 25% of the voting rights or capital and proof of authority if the bidder is acting as an agent.
Acuitus will also need to receive satisfactory identification on the source of the deposit money provided by the bidder/buyer.
If you are the successful bidder, Acuitus requires a separate payment of £1,500+VAT as a buyer's administration charge payable to Acuitus Limited upon exchange of contracts. A VAT receipt will be provided upon payment.
The Common Auction Conditions have been updated as at June 2024.
Lot 4
West End House, 288 West Street, Fareham, Hampshire, PO16 0AJ
If at the date of completion the tenant has vacated the property then the seller will assign to the buyer the benefits of all rights arising from the lease in terms of any dilapidation claim or any outstanding claim for breach of the terms of the lease by the tenant except for any arrears of rent as maybe outstanding to the date of completion which shall remain the absolute entitlement of the seller. With respect to Special Condition 2.4, the Seller gives no warranty as to what fixtures and fittings will remain at the property on completion of the sale.
In respect of the Extra Special Conditions of Sale in the Legal Pack, please note that a new clause 2.7.1.9 has been added stating: ‘’all rights or entitlements that adjacent properties have or may claim to have as to access over or parking on the property’’. In respect of access rights, an email dated 30th October from Claire Ayling, an owner occupier from one of the Cottages on the western boundary of the property has been received by the Auctioneers & uploaded to the legal pack, confirming that the title documents do not clearly record access rights for the benefit of all the cottages that lie to the Western boundary of the property. It is the sellers understanding that for in excess of 20 years the owners/occupiers of the cottages will have exercised access rights to all of the cottages over the roadway coloured brown on the title plan, but the buyer must rely upon their own inspection to be satisfied as to the precise route of the access . The seller is not in occupation so can provide no further information. In respect of Parking Rights, letters dated 15th June 2004, 19th June 2007, 22nd June 2007 and 10th October 2012 have been received by the Auctioneers and have been uploaded to the legal pack as being letters from the present tenant to occupiers of the adjacent cottages. The seller is not in occupation of the property & has no knowledge of any on-going issue & can provide no further information.
