ADDENDUM

All Lots

The purchaser of each lot is deemed to purchase with notice and full knowledge of the important notice to bidders, the Common Auction Conditions, where applicable, the special conditions of sale and this addendum.

The purchaser of each lot is deemed to have inspected the property and have verified the accuracy of all information given in the particulars including the extent of the premises to be sold and the floor areas. Additionally, the purchaser is deemed to have read the legal documentation.

The boundary plans in the auction catalogue are for identification only. The correct title plan showing the boundaries of the properties are available for inspection and the purchaser will be deemed to have purchased with full knowledge thereof.

Please note that vendors may require a supplementary amount to be paid by the purchaser to the vendor over and above the purchase price. Please check the special conditions of sale to ascertain whether this applies to the property for which you are bidding.

The Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 came into force on the 26th June 2017.

Under the Regulations, Acuitus is legally required to immediately undertake customer due diligence checks on the buyer and related parties.

Acuitus will need to receive identification documents that satisfy the Regulations for the bidder, the buyer (if different from the bidder), the beneficial owners with more than 25% of the voting rights or capital and proof of authority if the bidder is acting as an agent.

Acuitus will also need to receive satisfactory identification on the source of the deposit money provided by the bidder/buyer.

If you are the successful bidder, Acuitus requires a separate payment of £1,500+VAT as a buyer's administration charge payable to Acuitus Limited upon exchange of contracts. A VAT receipt will be provided upon payment.

The Common Auction Conditions have been updated as at June 2024.

Lot 8

Lyndum House, 12-14 High Street, Petersfield, Hampshire, GU32 3JG

Please note that the Property is subject to two licences in respect of two car parking spaces, each currently let at £750 + VAT per annum, copies of which can be found in the Legal Pack. The parking licences are not completed yet but are paid up to June. The total current rent passing therefore should read £67,385 p.a. and not as stated in the auction particulars.

In respect of footnote (6) in the auction particulars, please note the lease to Connective Solutions Limited has now completed (Room 14 first floor) and a copy of this lease has been added to the Legal Pack.
The tenant of Room 15 first floor has signed and returned the renewal lease. The lease will be completed on expiry of the notice period required under the Landlord and Tenant Act 1954. A copy of the signed (but undated) lease has been added to the legal pack.

Variations to replies to CPSE 7 Question 16
Further correspondence has been received relating to the electricity supply to the shop units. Please refer to the correspondence marked “CPSE7 Q16” which has been added to the legal pack. The seller believes this may relate to the vacated front ground floor shop unit. The seller has notified Messrs Biscoes that the rent deposit for the vacant front ground floor shop unit has been utilised in full and is now looking to finalise a surrender with the missing tenant in order to ease the marketing and reletting process going forward. Please refer to the correspondence marked “CPSE7 Q16 (2) which has been added to the legal pack.

We summarise below a breakdown of the repair and maintenance expenditure (incurred in excess of £500 only) carried out at the Property and referred to in CPSE2 10.1
April 2020 £25,500* plus VAT spent on major roof works
May 2020 £6,500* plus VAT spent on external decoration
August 2020 £2,000* plus VAT spent on drain works
June 2021 £720* plus VAT spent on miscellaneous internal repairs
January 2022 £15,000* plus VAT spent on tile hanging in the courtyard area near shops 2/3 (Lucy Graham)

These figures are based on the verbal confirmation of Nurstead Builders who carry out the maintenance work on behalf of the Seller and do not include any small repair items (such as replacement hinges etc) that cost less than £500. These figures are provided in good faith to guide prospective bidders.
